• WTO Rules Against US Gambling Ban

US laws prohibiting cross-border gambling break trade rules, the World Trade Organisation says. The WTO case was brought by the Caribbean state of Antigua and Barbuda, host to many of the online casinos whose use is illegal in the US. The ruling confirms a preliminary judgement issued in March. But the US said it will appeal and - as a last resort - could activate its right to change the deal under which it joined the WTO in the first place. "This panel report is deeply flawed," said a spokesman for US Trade Representative Robert Zoellick. An appellate panel will now consider the appeal over the next few months. [...]

• Ladbrokes Launches Helpline Programme In Ireland

One of the country’s largest betting chains has launched a programme to help problem gamblers. The Corporate Social Responsibility Programme has been launched by Ladbrokes and is based on a similar model operated by the chain in the UK for the past eight years. A freephone helpline (00 800 33 669 966) has been set up to link problem gamblers with GamCare, a UK-based organisation which provides on the spot help and advice to people with gambling problems and their families. The number will be advertised on posters in the chain’s 134 shops in this country. The programme includes a service whereby gamblers can sign a self-exclusion form requesting Ladbrokes staff to bar them from entering their betting offices. There is also provision for those who bet online to sign a form to ensure they are unable to gamble over the internet. Paul Bellinger , the former chief executive of GamCare said he hoped the initiative would be picked up by the Government and used to tackle all forms of problem gambling in this country “It is a fact of life that some people suffer problems with gaming and it is incumbent on the gaming industry to recognise this fact and support those who have difficulty staying in control,” he said.

• DOJ Defends Crackdown On Internet Gambling

A Greenberg Traurig lawyer in Fort Lauderdale has sued the U.S. Department of Justice on First Amendment grounds to force the feds to back off their crackdown on Internet-based gambling. Patrick O'Brien, a Greenberg partner, filed suit in U.S. District Court in Louisiana, alleging that the Justice Department's crackdown on Internet gambling advertising violates the free speech rights of his client, Massachusetts-based Casino City Inc. The lawsuit, filed in August, is apparently the first brought against the federal government on the legality of online gambling, a multibillion-dollar global industry that is growing rapidly. Half the industry's customers are in the United States. While the online casinos mainly are operated offshore, Internet portals and broadcast and print outlets in the United States run ads about the Web sites. In its motion to dismiss filed last week, the Justice Department claimed that Casino City was not under threat of prosecution. [...]
